GENERAL TERMS AND CONDITIONS FOR SERVICES
Applicability.
These terms and conditions (these “Terms”) apply when Prairie Poppins Animal Care LLC (“Pet Sitter”) provides services to the customer named on the booking (“Customer”).
These Terms and the booking together comprise the entire agreement between the Pet Sitter and the Customer, replacing any previous discussions or agreements. If there is a conflict between these Terms and the booking, these Terms will take precedence.
Services.
Pet Sitter shall provide the services to Customer as described in the booking (the “Services”) in accordance with these Terms. Pet Sitter reserves the option to alter the Services if weather conditions or other circumstances reasonably prevent Pet Sitter from performing the Services as booked. For example, Pet Sitter may engage in indoor play or training for some or all of the booked Services if the weather conditions are not suitable for sustained outdoor activity.
Pet Sitter will use best efforts to meet the estimated time for Services but they are not guaranteed. Pet Sitter will attempt to provide updates to the Customer in the event of delays through Customer’s preferred method of contact.
The booked Services time shall commence upon Pet Sitter’s arrival at Customer’s premises. The duration of the visit may include time required for preparation, pet care, and any necessary activities to ready the pet for the scheduled service (including but not limited to feeding, providing water, harnessing, or cleaning up after the pet). Accordingly, walking, exercise, or playtime is not guaranteed for the entire duration of the visit, and the actual time spent on these activities may be reduced as reasonably necessary to accommodate the pet’s overall care and preparation needs.
Pet Health. Upon request, Customer will provide Pet Sitter with satisfactory evidence that the pet is current on all state mandated vaccinations. Customer shall disclose to the Pet Sitter any health, nutrition or behavior conditions or requirements for the pet.
Property Access. Customer must ensure access is available to where pet is kept at the times/dates agreed, including clear paths to a driveway and all walkways and entrances in the event of snow or ice. Charges will still apply if access to the property cannot be gained.
Supplies. Customer agrees to provide all food, treats, or dog waste bags for the pet. If Pet Sitter must provide food, treats, or dog waste bags, additional fees will be charged to Customer.
Cancellation Policy.
The full fee of service will be charged if service is cancelled by Customer on the same day service is to be performed. There is no charge if service is cancelled with more than 24 hours' notice.
Pet Sitter may cancel if Pet Sitter is ill or due to inclement weather. Pet Sitter will provide notice as soon as possible once Pet Sitter becomes aware of unavailability so that Customer can make other arrangements.
Transportation. Pet Sitter has permission to transport pets in a car and will keep the pet as safe as possible during transport. Pet Sitter is not liable if the pet is harmed during transportation.
Emergency Care. Pet Sitter reserves the right to act in the best interests of the pet at all times which includes seeking veterinary advice and/or emergency services if the pet becomes ill or injured. Pet Sitter will contact Customer immediately should the pet become ill or injured. If Customer cannot be contacted within a reasonable time or has chosen not to be contacted, Pet Sitter reserves the right to seek appropriate and swift veterinary attention and proceed with treatment. Customer agrees to be responsible for all charges.
Security Cameras. In advance of Services where Pet Sitter will be staying at Customer’s home for multiple days during the Services, Customer agrees to notify Pet Sitter of any security cameras located inside the home, including the location of the security cameras.
Service Rates. Pet Sitter maintains the right to periodically adjust service rates with notice to Customer.
Payment Terms. Payment in full is required at the time of booking. Payment for any costs incurred during Services provided will be charged to the credit card on file or invoiced separately. Failure to make payment in full within 5 days will result in a late fee of $25 per day.
Termination of Services. Pet Sitter maintains discretion to terminate Services early if the pet(s) attacks, bites or otherwise injures the Pet Sitter or other Pet Sitter personnel. Pet Sitter reserves the right to refuse Services for any pet that does meet health, temperament or other safety standards.
Limitation on Liability / Hold Harmless. Customer agrees to fully release from liability and hold harmless the Pet Sitter, its owners, employees, contractors and agents from any and all claims, damages, costs and expenses should the pet(s) be lost, injured (including death) or contracts any malady, illness or disease during the Services, absent Pet Sitter’s gross negligence or intentional misconduct. If the pet(s) causes property damage, or bites or injures any other pet or person during the Services, Customer agrees to pay all resulting losses, damages and costs suffered or incurred with respect thereto, and to defend, indemnify, and otherwise hold harmless Pet Sitter, its owners, employees, contractors and agents from any and all resulting claims, demands, lawsuits, losses, costs, or expenses, including attorney fees.
Relationship of the Parties. The relationship between the parties is that of independent contractors. Nothing contained in this Agreement shall be construed as creating any agency, partnership, joint venture or other form of joint enterprise, employment, or fiduciary relationship between the parties, and neither party shall have authority to contract for or bind the other party in any manner whatsoever.
Governing Law. All matters arising out of or relating to this Agreement are governed by and construed in accordance with the internal laws of the State of New Hampshire without giving effect to any choice or conflict of law provision or rule (whether of the State of New Hampshire or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the State of New Hampshire.
Submission to Jurisdiction. Any legal suit, action, or proceeding arising out of or relating to this Agreement shall be instituted in the federal courts of the United States of America for the District of New Hampshire or the courts of the State of New Hampshire, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action, or proceeding.
Notices. All notices, requests, consents, claims, demands, waivers, and other communications hereunder (each, a “Notice”) shall be in writing and addressed to the parties at the addresses set forth in booking or to such other address that may be designated by the receiving party in writing. All Notices shall be delivered by personal delivery, nationally recognized overnight courier (with all fees pre-paid), email, or certified or registered mail (in each case, return receipt requested, postage prepaid). Except as otherwise provided in this Agreement, a Notice is effective only (a) upon receipt of the receiving party, and (b) if the party giving the Notice has complied with the requirements of this Section.
Severability. If any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.
Amendment and Modification. This Agreement may only be amended or modified in a writing which specifically states that it amends this Agreement and is signed by an authorized representative of each party.
